1. Information We Collect

• Technical and operational information you provide in connection with technology services engagements, such as network configurations, system environments, infrastructure details, or account access necessary to deliver services under a separate services agreement or statement of work.

• Cookies and similar tracking technologies, as described in Section 5 below.

c. Information from Third Parties

• Credit reporting agencies and fraud-prevention services, used to evaluate financing applications.
• Equipment vendors, dealers, brokers, and referral partners who submit applications or information on your behalf.
• Publicly available sources and commercial data providers, which we may use to verify or supplement the information we hold.

d. Identity Verification (USA PATRIOT Act)

Federal law, including requirements associated with the USA PATRIOT Act, requires us and the funding sources we work with to obtain, verify, and record information that identifies each individual and business seeking a business loan or other extension of credit. This may include your business name, address, and taxpayer identification number, and we or our funding partners may ask to see a driver's license or other identifying documents. This information is used and retained in accordance with applicable federal law.

e. Business-Purpose Financing Only

All credit extended through the Site is for business, commercial, or agricultural purposes and is not primarily for personal, family, or household use. Where an individual, such as a business owner, sole proprietor, or personal guarantor, provides personal information, a taxpayer identification or Social Security number, or consents to a credit inquiry in connection with a business financing application, that information is collected and used solely for evaluating, verifying, and processing the underlying business transaction, as described throughout this Privacy Policy.

2. How We Use Your Information

We use the information we collect to:

• Deliver, operate, and support technology services engagements under a separate services agreement or statement of work.
• Refer your information to a separate broker company where you express interest in financing for a purchase; we do not ourselves process, evaluate, or connect you with a funding source for that financing.
• Verify your identity and prevent fraud, in accordance with the Fair Credit Reporting Act and other applicable laws.
• Improve, operate, and maintain the Site and our Services.
• Comply with legal, regulatory, and contractual obligations.
• Send you marketing and promotional communications, with your opt-in consent, as described in Section 4 below.

3. We Do Not Sell Your Personal Information

NexTech Business Solutions does not sell your personal information to third parties for monetary or other valuable consideration, and we do not share your personal information with third parties for their own independent marketing purposes without your consent. We may share your information only in the limited circumstances described in Section 6 below (for example, with service providers who work on our behalf, or as required by law).

4. Marketing Communications — Your Opt-In Consent

We will only send you marketing or promotional communications if you have affirmatively opted in to receive them. We do not enroll you in marketing communications by default, and opting in to one channel (e.g., email) does not automatically opt you in to another (e.g., text messages).

a. Email Marketing

• We may send newsletters, product updates, and promotional offers directly or through a third-party email marketing service provider, to subscribers who have affirmatively opted in.
• If we use a third-party email marketing service provider, your contact information (such as name and email address) is shared with that provider solely to deliver the communications you requested, in accordance with that provider's own privacy and security practices, and under a contract that restricts its use of your information to providing services to us.
• Every marketing email includes a clear, working "unsubscribe" or opt-out link.
• You may withdraw your consent at any time by using the unsubscribe link or by contacting us at customerservice@nextechbusinesssolutions.com.

b. Text Message (SMS) Marketing

If you separately opt in to receive text messages from us, you will be asked for your prior express written consent, as required by the Telephone Consumer Protection Act (TCPA). By opting in, you agree that:

• Message and data rates may apply, and message frequency varies.
• You may opt out at any time by replying "STOP," and may request help by replying "HELP."
• Consent to receive text messages is not a condition of obtaining financing or any other service from us.
• Carriers are not liable for delayed or undelivered messages.

c. General

Opting out of marketing communications (by any channel) will not affect transactional or account-related communications, such as payment notices, contract documents, adverse action notices, or other legal notices, which we may continue to send as necessary to service your account or comply with law.

5. Cookies and Tracking Technologies

The Site uses cookies, web beacons, and similar technologies to operate the Site, remember your preferences, analyze traffic, and, where you have consented, support marketing activities. You can control cookies through your browser settings; disabling cookies may affect Site functionality. Where required by law, we will present a cookie consent banner allowing you to accept or reject non-essential cookies.

6. How We Share Your Information

We may share your information with:

• Service providers who perform functions on our behalf, such as hosting, payment processing, credit verification, document management, and email or text marketing delivery, under contractual confidentiality obligations.
• Third-party funding sources or lenders to whom we submit or refer your application for financing, where applicable; we do not fund financing transactions ourselves.

• Government authorities or regulators, where required to comply with law, subpoena, audit, or legal process.
• A successor entity, in connection with a merger, acquisition, financing, or sale of assets, subject to this Privacy Policy or a substantially similar policy.

We do not share your personal information with third parties for their own independent marketing purposes without your consent, and, as stated above, we do not sell your personal information.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to service active accounts, satisfy legal, tax, accounting, and regulatory retention requirements, and resolve disputes. Retention periods vary depending on the type of information and applicable legal requirements.

Depending on your state of residence, you may have rights under applicable privacy laws (such as the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and similar laws in other states), including the right to:

Do Not Sell or Share; Global Privacy Control

If we sell or share personal information, as those terms are defined under California law (including for cross-context behavioral advertising), we will provide a "Do Not Sell or Share My Personal Information" link, or a combined "Your Privacy Choices" link, on the Site. We will detect and honor Global Privacy Control (GPC) signals and other recognized opt-out preference signals as valid requests to opt out of the sale or sharing of personal information associated with the browser or device sending the signal, and will provide a visible confirmation once an opt-out has been honored.

9. Data Security and Incident Notification

We maintain administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a security incident involving your personal information, we will notify affected individuals and any required regulators in accordance with applicable state and federal breach notification laws.

10. Automated Decision-Making Technology

NexTech Business Solutions does not currently use automated decision-making technology to make or substantially assist in a significant decision about you. If this changes, we will provide notice describing any automated tool's role and the categories of information it uses before it is used to make or substantially assist in a significant decision about you. You will have the right to opt out of that use in favor of human review, except where an exception applies under law, and the right to request an explanation of how the technology was used in a specific decision about you, including the key parameters that affected the outcome. 11. Children's Privacy

The Site and our Services are intended for business use by adults and are not directed to individuals under the age of 18. We do not knowingly collect personal information from children.
